These Terms & Conditions (“Terms”) govern your access to and use of booketernis.com and the services offered by Eternis Tours (“we,” “us,” “our”). By accessing the Site or booking a tour, you agree to be bound by these Terms.
1. Definitions
- “Customer” refers to any individual booking a tour or service through the Site.
- “Travel Agent” refers to a registered partner booking on behalf of customers.
- “Supplier” refers to a registered provider of accommodation, transport, or tour services listed on the Site.
- “Booking” refers to a confirmed reservation for any tour, package, or service offered through the Site.
2. Eligibility
By using the Site, you confirm that you are at least 18 years of age and have the legal capacity to enter into binding agreements. Bookings made on behalf of minors must be made by a parent or legal guardian.
3. Account Registration
Customers, travel agents, and suppliers may be required to register an account to access certain portal features. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. Notify us immediately of any unauthorized use.
4. Bookings and Payments
4.1 All bookings are subject to availability and confirmation by Eternis Tours or the relevant supplier.
4.2 Prices displayed on the Site are quoted in [currency] and are subject to change without notice until a booking is confirmed and paid for.
4.3 Payments are processed securely through our designated payment gateway. By submitting payment, you authorize us to charge the applicable amount, including any deposit or balance due in accordance with the payment schedule presented at checkout.
4.4 A booking is only confirmed upon receipt of full or partial payment, as specified for the relevant tour or package, and issuance of a confirmation notice.
5. Travel Agent Bookings
Travel agents booking on behalf of customers represent and warrant that they have obtained the necessary authority and consent from the customer to make such bookings and share relevant personal information with Eternis Tours.
6. Supplier Listings
Suppliers registered on the Site are responsible for the accuracy of their listings, pricing, and availability. Eternis Tours reserves the right to remove or suspend any supplier listing that violates these Terms or applicable law.
7. Cancellations and Refunds
Cancellations, modifications, and refunds are governed by our separate Cancellation Policy, which forms part of these Terms by reference.
8. Customer Responsibilities
You agree to:
- Provide accurate and complete information at the time of booking
- Carry valid identification, passports, and visas as required for travel
- Comply with the laws and regulations of the destination(s) visited
- Arrive at designated meeting points and times as instructed
9. Limitation of Liability
To the maximum extent permitted by law, Eternis Tours shall not be liable for:
- Delays, cancellations, or changes caused by third-party suppliers, weather, or events beyond our reasonable control (force majeure)
- Loss of personal belongings during a tour
- Indirect, incidental, or consequential damages arising from use of the Site or participation in a tour
Our total liability for any claim arising from a booking shall not exceed the total amount paid by the customer for that booking.
10. Intellectual Property
All content on the Site, including text, images, logos, and design elements, is the property of Eternis Tours or its licensors and may not be reproduced, distributed, or used without prior written consent.
11. Force Majeure
Eternis Tours shall not be held responsible for failure to perform any obligation due to causes beyond its reasonable control, including natural disasters, government action, civil unrest, or pandemics.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of Mauritius. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Mauritius.
13. Amendments
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page, and continued use of the Site constitutes acceptance of the revised Terms.
